According to legal expert Vengai Madzima, Senior Partner at Madzima Chidyausiku Museta Legal Practitioners, economic hardships have rendered many unable to meet their financial obligations. This reality has led to increased tensions between creditors and debtors, making it crucial for both parties to understand their legal rights and remedies.

How debts are secured and enforced in Zimbabwe

Debt collection in Zimbabwe begins with a formal demand letter outlining the amount owed, applicable interest, and when the payment was due. According to Madzima, this step determines whether the debt is still legally enforceable under the country’s prescription laws.

To secure debts, creditors can use various instruments:

  • Mortgage Bonds: For debts involving immovable property.
  • General Notarial Bonds: Securing movable properties.
  • Special Notarial Bonds: Securing specific movable assets.
  • Pledges and Cessions: Debtors may pledge movable assets or assign rental proceeds to creditors.
  • Guarantors and Sureties: Common in lease agreements, third parties agree to cover the debt.
  • Debentures: A company’s assets can back the debt.

Once a debt is secured, enforcing repayment often involves the sale of the debtor’s property or garnishment of wages. Failure to comply with court orders can lead to civil imprisonment if the debtor has the capacity to pay but refuses.

Debtors’ rights during debt recovery

Debtors, despite their financial obligations, retain key rights under Zimbabwean law. Madzima stresses that they should be treated fairly and not subjected to harassment or abusive practices by creditors. Key rights include:

  • Transparency: Debtors must receive clear information about what they owe, including legally compliant interest calculations.
  • Dispute Resolution: Debtors have the right to dispute claims and seek legal representation.
  • Fair Treatment: Creditors must operate within legal boundaries, avoiding intimidation or coercion.

These rights aim to ensure that debt collection processes remain civil and legally compliant, protecting debtors from exploitation while enabling creditors to recover their dues.

Challenges and remedies in debt collection

Madzima notes that many creditors attempt to criminalize debt recovery, which is a civil matter, or resort to self-help measures that often end disastrously. Both practices are illegal and underscore the need for creditors to follow structured legal channels.

Additionally, debts that remain uncollected for a long period may become unenforceable unless interrupted by legal actions or instruments like acknowledgements of debt. Thus, prompt action is critical for creditors seeking to recover their dues.
